These Standard Terms and Conditions (these “Terms” or these “Standard Terms and Conditions”) contained herein together with the privacy statement, shall govern the use of this website/mobile application, including all pages within this website/mobile application and also other websites/mobile applications linked to this website/mobile application (collectively referred to herein below as this “Platform”). These Terms apply in full force and effect to the use of this Platform and by using this Platform all terms and conditions contained herein are expressly accepted in full. This Platform should not be used, if there is any objection to any of these Standard Terms and Conditions.

RICE has the right to amend the information, including any or all information, including but not limited to information relating to courses, units, programs, admissions, scholarships, fees, examinations and services on this Platform at any time and without notice. Unless otherwise stated, links with linked websites should not be construed as an endorsement, approval or recommendation by RICE of the owners or operators of those linked websites, or of any information, graphics, materials, products or services referred to or contained on those linked websites.

4. Disclaimers

RICE does not accept responsibility for any loss or damage, however caused (including through negligence), which may directly or indirectly be suffered in connection with the use of and/or or reliance on information contained on and/or accessed through the Platform or any linked website.

To the extent permitted by law, any condition or warranty which would otherwise be implied into these terms and conditions is hereby excluded. Where legislation implies any condition or warranty, and that legislation prohibits RICE from excluding or modifying the application of its liability under, any such condition or warranty, that condition or warranty will be deemed included, but liability of RICE will only be limited to supplying of services against receipt of stipulated fees.

The Visitors to the Platform or any linked websites must take their own precautions to ensure that the process(es) employed for accessing the Platform or any linked websites does not expose him/her to the risk of viruses, malicious computer code or other forms of interference which may damage their computer system. RICE and/or its licensors own all rights to the intellectual property and material, (including text, graphics, videos, audios, logos and icons) contained in this Website, and all such rights are reserved.

6. Restrictions.

The Viewers of the Platform are expressly and emphatically restricted from any and all of the following:

Certain areas of this Platform are/may be restricted from access and RICE shall have the right to restrict further access to any other areas of this Platform, at any time, in its sole and absolute discretion. Any user ID and password the Viewers may have for this Platform are confidential and confidentiality of such information must be maintained.

7. Your Content.

In these Standard Terms and Conditions, “Your Content” shall mean any audio, video, text, images or other material any Viewer may choose to display on this Platform, if the same is permitted by RICE and/or the Platform, either as of now or in future. With respect to Your Content, by displaying it, RICE is granted a non-exclusive, worldwide, irrevocable, royalty-free, sub-licensable license to use, reproduce, adapt, publish, translate and distribute it in any and all media.

Your Content must be belonging to the Viewer uploading the same and must not be infringing on any third party’s rights. RICE reserves the right to remove any of Your Content from the Platform at any time, and for any reason, without notice.

8. Security of information over the Internet

No data transmission over the Internet can be guaranteed as totally secure. Whilst RICE strives to protect such information however security of any information transmitted through the Platform cannot be warranted and ensured. Accordingly, any information which is transmitted through the Platform is at the Viewer’s/User’s risk. Nevertheless, once any transmission is received, reasonable steps shall be undertaken to preserve the security of such information.

9. Indemnification.

The Viewer visiting the Platform hereby indemnify RICE to the fullest extent from and against any and all liabilities, costs, demands, causes of action, damages and expenses (including reasonable attorney’s fees) arising out of or in any way related to his/her breach of any of the provisions of these Terms.

10. Severability.

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deemed to be non-existent without affecting the remaining provisions herein.

11. Variation of Terms.

RICE is permitted to revise these Terms at any time as it may deem fit, and by using the Platform Viewers are expected to review such Terms on a regular basis to ensure and understand all terms and conditions governing use of the Platform.

12. Assignment.

RICE shall be permitted to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification or consent required. However, the Viewer shall not be permitted to assign, transfer, or subcontract any of his/her rights and/or obligations under these Terms.

13. Termination of access to the Platform

Access to the Platform or any linked websites may be terminated at any time without notice. However, the disclaimers will survive any termination.

14. Entire Agreement.

These Terms, including any legal notices and disclaimers contained on the Platform, constitute the entire agreement between RICE and the Viewer in relation to his/her use of the Platform, and supersede all prior agreements and understandings with respect to the same.

15. Governing Law & Jurisdiction.

These Terms will be governed by and construed in accordance with the laws of India, and the Viewers submit to the exclusive jurisdiction of the courts in Barasat, in the District of North-24 Parganas, West Bengal, India for the resolution of any disputes.
